Ernest Jones murdered Richard Turner at the Co-Operative Store, Lepton, near Huddersfield on 30 September, 1958.

Ernest Jones had burgled the Co-Operative Store in 1957 and thought it was time he went back. He entered the premises and started to bundle together some cigarettes and clothing but was surprised when Richard Turner entered the building who he hit on the head and ran off.

He appealed and said that by the time Richard Turner had arrived he had completed his theft and as such the murder was not capital because it was not in order to further his theft but the judge said that if a murder was carried out in order to get away then it is still murder in the course of theft.
